In the SC hearing today on the plea to postpone CA Exams 2021, final orders will be passed tomorrow. The Bench asked ICAI to give the option of opting out on COVID-19 grounds, among other reasons.
Image Source: Times Now News Supreme Court of India: The SC heard the plea on postponing the Chartered Accountants, CA Exams 2021 today. Even though the final hearing is tomorrow, the SC is in favor of giving the CA aspirants an opt-out option rather than a postponement of exams. Along with that, the Bench even raised points related to the RT-PCR certificate and the change of examination centers. A Bench of Justices AM Khanwilkar, Dinesh Maheshwari, and Aniruddha Bose, asked the Institute of Chartered Accountants of India (ICAI) if an alternative option other than RT-PCR certificate can be adopted to know whether a candidate is medically unfit to appear for the CA exams, starting from July 5th. The Bench further mentioned that the effects of COVID-19 can be long-lasting, and a mere negative result in the RTPCR certificate may not reflect the fitness of the candidate. The bench also heard arguments raised on vaccination centers and enquired about the examinations center. Answering that the court said that institutions cannot be held accountable for getting students vaccinated.
Although it stated that if there is a change in the examination center at the last minute, students have an option to opt out from the exams. However, the conclusion from today’s discussion is, the bench will file an SOP in the Court and the SOP will take the following points into consideration • Alternate options for the condition of RT-PCR certificate. • Examiners who are going to conduct exams should have RTPCR tests done before the date of exams. • Ensuring that exam centers are not used for other purposes like marriage function and that their exclusivity is maintained. • If during the middle of the exam a candidate suffers Covid, he should be permitted to take the remaining papers in the next cycle. • In case of last-minute change of exam center, an option to select an alternate exam center or opting out should be given to the candidate.
One of the Chief Justice, AM Khanwilkar, is still of the opinion that CA exams would not be postponed. The final decision is yet to be taken and it will be declared tomorrow.
