Gudiya rape-murder case: Lone accused in the four-year-old case, found guilty

A horrific incident occurred on July 4th, 2017, a 16-year-old girl went missing, while returning home from school and an FIR was reported. Two days later her lifeless body was recovered in Halaila forests, Shimla and later the postmortem reports confirmed she was gang-raped and strangled to death. Protest:

The violent protest took out on the street after the news was out. People from all walks of life, students, homemakers, commoners took out candlelight March demanding swift action against the guilty. Outrage against SIT:

After a lot of political uproars, a special investigation team was launched, and they cracked the case within nine days and they made 6 arrests that day, out of which one died in police custody, which led to more outrage. The people further alleged that the 6 innocents were being framed in order to protect the rich and influential. Case to CBI:

On July 19th the Himachal Pradesh High Court handed the case over to the CBI, amid a public outburst against the state police. They alleged that in order to solve the case, the SIT detained and arrested innocent people. The CBI arrested 9 police officers including the IGP for custodial death and they dropped the case against 5 men due to lack of evidence. The CBI claimed to arrest the key suspect in a rape and murder case, i.e. Anil Kumar, a woodcutter from the Hatkoti area on 13th April 2018. Special Judge Rajiv Bharadwaj gave the verdict and held Anil Kumar guilty under 376(2)(i), 376(A), and 302 of the Indian Penal Code and section 4 of the POCSO. Out of 14 pieces of evidence, 12 turned out to be against Anil, most important being the DNA that matched the crime scene. Sought reinvestigation: However, dissatisfied with the CBI investigation, the victim’s family member filed a petition on 15 October 2020 in Himachal High Court seeking reinvestigation into the case by CBI under the supervision of a sitting judge of the high court. On April 28, 2021, they held Lumberman Anil Kumar guilty of rape and murder and reserved the pronouncement of punishment for May 11, 2021
