Plea Filed Against Rahul Gandhi For Violating Provisions Of POCSO And Juvenile Justice Act.

A plea had been filed in the High Court of Delhi by a social activist, Makarand Suresh Mahadlekar through advocates Gautam Jha, Pankaj Kumar and Sweta Jha against the opposition leader, Rahul Gandhi for uploading a picture of the victim’s parents of Delhi Cantt. Rape case on his Twitter handle. The plea urged the Delhi Police to register an FIR, requesting the National Commission for Protection of Child Rights (NCPCR) to take necessary legal actions against violation of Section 74 of the Juvenile Justice Act, 2015, and Section 23(2) of the Protection of Children from Sexual Offences Act (POCSO), 2012. Provisions under both acts mandate the protection of the identity of a child who has been a victim of a crime. Upon its violation, the offender is punishable with imprisonment for a term which may extend to six months or a fine of ₹2 lakh or both under the Juvenile Justice Act, whereas will be subjected to imprisonment for a period of a minimum of six months and maximum one year under POCSO.



“It is submitted that Rape, particularly that of a minor girl, is one of the grossest crimes committed against children. Disclosure of such crimes to the outside world only adds to the agony of the family of the victim and the victim herself. By doing so the Respondent No.1 has put the lives of the victim's family members at high risk." The plea stated. It also urged Twitter to remove the post.


The Delhi Cantt. A rape case has been a sensitive issue as a minor of only 9 years old who was Dalit had been the victim of a gang- rape and was heinously murdered later. The plea did not hesitate to state that the act was nothing but an attempt to fulfil the respondent’s political agenda through the unfortunate incident.


The court is likely to hear the case on August 11.
